An Affidavit of Financial Hardship is a document that explains to your lender the reasons you are facing trouble making loan payments and that you should be a candidate for a loan payment modification.

The Affidavit of Financial Hardship must be signed under oath and penalty of perjury in the presence of a notary public that you are not misrepresenting your finances or intentionally missing mortgage or loan payments to get the loan modification.

To file an Affidavit of Financial Hardship in most states you need to:
• Complete the Affidavit of Financial Hardship. The Hardship Affidavit requires that you state under oath that you are unable to pay your loan obligation because of serious, legitimate financial difficulties.
• Fill out the financial worksheet part of the Financial Hardship Affidavit that details your assets and debts, income, and expenses under oath.
• File the Affidavit of Financial Hardship and the financial worksheet with the clerk of the court.

Remember that the Affidavit of Financial Hardship must be stamped and signed by a notary public and all of its contents are held truthful under penalty of perjury.
